TERMS AND CONDITIONS FOR PHOTOGRAPHY & VIDEOGRAPHYSERVICES
1. TERMS AND CONDITIONS
1.1 The Photographer reserves the right to amend these Terms and Conditions, as well as any associated specific terms, at its sole discretion when reasonably necessary (e.g., due to legal changes or changes inservice offerings).
1.2 Notifications of amendments shall be made through the website, and individual notifications will not be provided. Amended terms and conditions will apply to services booked after the effective date of the amendments.
1.3 Any amendments to these Terms and Conditions shall become effective after posting on the Photographer’s website: www.simonbonny.com . By continuing to use the Service after this period, the Client is deemed to have accepted the amended Terms and Conditions.
2. APPLICATION FOR SERVICE
2.1 Applications to use the Service shall be made via email, telephone, or other communication methods as offered by the Photographer. By making a booking, the Client agrees to these Terms and Conditions.
2.2 A contract for the Service is formed when the Photographer accepts the Client’s application and receives the required deposit.
3. PHOTOGRAPHY FEES
3.1 Fees for photography services are calculated based on the rates detailed in the "Price" section of the Photographer’s website. Charges apply from the commencement of the photography session until its conclusion (when the photographer reasonably finishes the shoot and begins packing equipment). Any necessary early arrival for location scouting, setup, or preparation will not be billed unless otherwise agreed upon in advance.
3.2 If the actual photography session duration is equal to or shorter than the estimated time, the quoted amount will be charged. If the session exceeds the estimated duration, additional fees will apply as per thewebsite’s pricing structure, subject to the Photographer’s availability. Extensions of time are not guaranteed.
4. PAYMENT OF SERVICE FEES
4.1 The Photographer will issue an invoice via email, outlining acceptable payment methods (e.g., bank transfer, credit card or cash). The Client agrees to pay outstanding invoices by the specified due date using the stipulated payment method. The Photographer retains a lien over the final images or videos until full payment is received.
4.2 If no specific due date is provided, payment must be made within 30 days from the invoice date. The Client is responsible for any bank transfer or transaction fees. The Photographer will only proceed with delivery after confirming full payment.
5. DELIVERY OF MATERIALS
5.1 The Photographer will aim to deliver the final images or videos within approximately fourteen 14 business days from the photography date, provided payment has been confirmed. However, during peak seasons, incases of illness, or when the Photographer is traveling for work, delivery may take longer. If a delay is reasonably expected, the Photographer will notify the Client with an updated estimated delivery timeframe. Any special delivery timelines agreed upon in writing in advance will take precedence.
6. POST-DELIVERY PAYMENT ARRANGEMENTS
6.1 Requests for post-delivery payment are subject to the Photographer’s approval based on internal procedures and may not be granted as a standard arrangement. The Client will be notified if such payment terms are agreed upon in writing.
6.2 Unless otherwise agreed in writing, the Client shall not use or store any delivered materials until full payment is received by the Photographer.
7. LATE PAYMENTS & DEBT COLLECTION
7.1 If payment is not received by the due date, the Photographer will issue a written notice to the Client, reminding them of the overdue payment.
7.2 A grace period of ten (10) days commencing from the day after the original due date will be provided for the Client to make the outstanding payment without penalty.
7.3 If payment is still not received after the grace period, a late payment interest rate may be applied to the overdue balance. The Photographer will notify the Client of the specific interest rate and calculation method.
7.4 For corporate clients with structured payment systems, payment terms must be agreed upon in writing in advance. Late payment interest may still apply if payment is delayed beyond the agreed timeframe without prior written arrangement.
7.5 In the event of persistent non-payment, the Photographer may take reasonable steps to recover the outstanding debt, which may include engaging a debt collection agency or initiating legal proceedings. The Client acknowledges that they may be responsible for reasonable collection costs incurred by the Photographer, to the extent permitted by law.
8. MODIFICATIONS TO THE PHOTOGRAPHY SCHEDULE
8.1 If the Client requests a change to the scheduled photography date, no rescheduling fee will be charged for the first request. However, if the Client wishes to reserve an additional date as a backup due to potential unforeseen changes, additional fee of 10% of the chosen photography rate per reserved date will apply subject to the Photographer’s availability and communicated at the time of booking.
8.2 For outdoor photography, one (1) complimentary reschedule is permitted due to adverse weather conditions or other significant unforeseen circumstances (including illness), provided the Client gives the Photographer reasonable advance notice.
8.3 If the Client does not propose a new schedule within fourteen (14) business days after requesting a change, the session may be deemed cancelled, and a cancellation fee (as outlined in clause 8.4) may apply.
8.4 Cancellation fees are as follows:
* Seven (7) days or more before the shoot: 50% of the quoted amount.
* Three (3) to six (6) days before the shoot: 80% of the quoted amount.
* One (1) to two (2) days before or on the day of the shoot: 100% of the quoted amount.
9. SECURING PHOTOGRAPHER AVAILABILITY
9.1 The Photographer’s availability is confirmed only after receiving the Client’s written confirmation of intent to proceed and any required deposit.
10. DISCLAIMER OF LIABILITY
10.1 To the extent permitted by law, the Photographer shall not be liable for any direct or indirect damages arising from the use or inability to use the Service, except where such damages are directly caused bythe Photographer’s wilful misconduct or negligence.
10.2 While the Photographer will take reasonable care during photography sessions, personal or confidential information may be inadvertently included in images or videos. To the extent permitted by law, the Photographer is not liable for any damages resulting from such inadvertent disclosures.
11. COPYRIGHT & USAGE RIGHTS
11.1 Copyright for all materials created by the Photographer remains with the Photographer and is protected under copyright law in Australia, Japan and Internationally.
11.2 The Client is granted a non-exclusive, non-transferable license for personal or the agreed commercial use, as specified in the booking agreement. Any additional licensing or usage beyond the agreed terms requires aseparate written agreement and may be subject to additional fees.
11.3 The Photographer reserves the right to use the final images or videos for reasonable promotional purposes (e.g., portfolio, website, social media) unless the Client explicitly requests otherwise in writing prior to the commencement of the shoot.
12. PRIVACY AND USE OF SENSITIVE IMAGES
12.1 The Photographer respects the privacy of all Clients and will take particular care with images involving families, children, nudesubjects, or military personnel.
12.2 In cases where images may be considered sensitive (especially those involving minors, nudity, or individuals affiliated with the military), the Photographer will seek explicit written consent (via email orother documented means) from the Client before using any such images for promotional purposes on platforms such as the Photographer’s website, blog, or social media.
12.3 Written permission provided by the Client via email or other documented means will be considered valid and sufficient consent for the Photographer to use the agreed-upon images for the specified promotional purposes. A clear reply granting permission will constitute a binding agreement.
12.4 If the Client does not provide explicit written permission, or if there is no clear documented reply granting permission, the sensitive images will remain private and will not be used for any public or promotional purposes by the Photographer.
13. FORCE MAJEURE
13.1 Neither party shall be liable for failure to perform their obligations under these Terms due to unforeseen circumstances beyond their reasonable control, including but not limited to natural disasters, acts of terrorism, war, civil unrest, strikes, widespread illness (e.g., pandemics), or governmental restrictions. The affected party shall promptly notify the other party of such circumstances and make reasonable efforts to mitigate the impact.
14. AGREEMENT
14.1 These Terms constitute the entire agreement between the parties and supersede any prior agreements, understandings, or representations, whether oral or written.
14.2 Any amendments to these Terms shall be made in writing and agreed upon by both parties.

写真および映像サービスの利用規約
第1条 規約の適用および変更
1.1 本利用規約（以下「本規約」といいます）は、写真家（以下「当方」といいます）が提供する写真および映像サービス（以下「本サービス」といいます）に関する条件を定めるものです。
1.2 当方は、法令の改正やサービス内容の変更等、合理的に必要と判断した場合には、予告なく本規約の内容を変更することができます。
1.3 規約の変更後は、当方ウェブサイト（www.simonbonny.com）上に掲示された時点で効力を生じるものとし、変更後に本サービスをご利用された場合には、当該変更に同意されたものとみなします。個別の通知は行いません。
第2条 サービスの申込みおよび契約の成立
2.1 本サービスの利用申込みは、電子メール、電話、その他当方が指定する方法により行ってください。
2.2 申込みが当方により承諾され、所定の内金（デポジット）を受領した時点で契約が成立します。
第3条 料金について
3.1 本サービスの料金は、当方ウェブサイトの「価格」ページに記載された料金表に基づき算出されます。撮影開始から機材の片付け開始までを撮影時間とし、それに応じて料金が発生します。事前のロケハンや機材設営のための早期到着については、別途合意がない限り、料金に含まれません。
3.2 撮影時間が事前見積もりと同等またはそれ以下であった場合、見積額が請求されます。見積もり時間を超過した場合は、当方の空き状況に応じて延長料金が発生します。
第4条 お支払い
4.1 当方は、電子メールにて請求書を発行し、銀行振込・クレジットカード・現金等の支払い方法を明示します。お客様は、指定の期日までに請求額を支払うものとし、全額の支払い確認後に成果物を納品します。
4.2 支払期日が明記されていない場合は、請求書発行日より30日以内にお支払いください。送金手数料はお客様負担とします。
第5条 納品について
5.1 撮影完了後、通常14営業日以内に写真・映像を納品するよう努めます（お支払い確認後）。ただし、繁忙期、出張、体調不良等により遅延が見込まれる場合には、速やかにその旨をご連絡いたします。あらかじめ合意された納期がある場合はそちらを優先します。
第6条 後払いに関する合意
6.1 納品後のお支払いをご希望の場合は、当方の承認が必要です。書面（メール含む）により明確な合意がない限り、後払いは適用されません。
6.2 合意のない場合、納品された素材の利用・保管はご遠慮ください。
第7条 遅延および債権回収
7.1 支払期日までに入金が確認できない場合、当方より書面による督促を行います。
7.2 督促後10日間の猶予期間内での支払いが可能です。
7.3 それでも入金がない場合、適用法に従って遅延利息が発生する場合があります。利率および計算方法は別途通知します。
7.4 法人のお客様で支払いフローに特別な手続きが必要な場合は、事前の書面による取り決めが必要です。
7.5 支払いが長期にわたり行われない場合、法的手続きや債権回収業者への委託を含む措置を講じる場合があります。その際に発生する合理的な回収費用は、法の許す範囲でお客様のご負担となります。
第8条 撮影日程の変更・キャンセル
8.1 お客様のご都合で日程変更を希望される場合、初回の変更に限り無料とします。ただし、予備日確保をご希望の場合は、追加で選択した料金の10%を1日ごとに加算いたします（空き状況により応相談）。
8.2 天候不良や体調不良等のやむを得ない事情により撮影を延期する場合、1回までは無料で再スケジュール可能です（事前連絡が条件）。
8.3 日程変更後、14営業日以内に新たな日程が提案されない場合は、キャンセルとみなされ、キャンセル料が発生します。
8.4 キャンセル料は以下の通りです：
- 撮影の7日以上前：見積額の50%
- 撮影の3〜6日前：見積額の80%
- 撮影の1〜2日前および当日：見積額の100%
第9条 予約確定
9.1 撮影の確保は、正式な予約意思の書面（メール等）およびデポジットの支払いをもって確定とします。
第10条 免責事項
10.1 法律の許す範囲において、当方は、本サービスの使用または使用不能から生じた直接的・間接的損害に関し、一切の責任を負いません。ただし、当方の故意または重過失による損害についてはこの限りではありません。
10.2 撮影中に個人情報や機密情報が意図せず写り込む場合がありますが、その場合の損害についても、法令が許す限り免責といたします。
第11条 著作権および使用許諾
11.1 撮影されたすべてのコンテンツに関する著作権はカメラマンに帰属し、オーストラリア、日本と海外に置いて著作権法により保護されます。
11.2 お客様には、個人利用または契約時に定めた商業利用に限定した非独占的・譲渡不可の使用権が付与されます。その他の利用には書面による別途合意が必要です。
11.3 当方は、制作物をポートフォリオ・ウェブサイト・SNS等の合理的な宣伝目的で使用する権利を有します。ただし、お客様が事前に書面で使用不可の旨を通知した場合はこれを尊重します。
第12条 プライバシーと機微な画像の使用
12.1 当方は、お客様のプライバシーを尊重し、特に家族・子ども・ヌード・軍関係者が含まれる写真に関しては慎重に取り扱います。
12.2 上記のような画像をプロモーション用途（ウェブサイト・SNS等）に使用する場合は、事前に書面（メール等）による明確な同意をいただきます。
12.3 同意の返信がある場合、その文面をもって有効な契約とみなします。
12.4 同意の記録がない場合、該当画像は非公開とし、宣伝等への利用は一切行いません。
第13条 不可抗力
13.1 自然災害、テロ、戦争、感染症の流行、政府の規制等、当事者の合理的管理を超える事由による義務の不履行については、責任を負いません。ただし、その発生を速やかに通知し、影響の軽減に努めるものとします。
第14条 合意の完全性
14.1 本規約は、両当事者間における完全な合意であり、従前の口頭または書面によるいかなる合意に優先します。
14.2 本規約に対する変更は、書面により両当事者が合意した場合にのみ有効とします。
